HILTON GRAND VACATIONS
“Build and Win Sweepstakes”
NO PURCHASE, CONTRIBUTION, HOTEL RESERVATION OR STAY REQUIRED TO ENTER OR WIN. VOID WHERE PROHIBITED BY LAW.
ELIGIBILITY: Sweepstakes only open to natural persons who are, at the time of entry, age 21 years or older, legal residents of the United States (excluding US territories, military installations and commonwealths). "Hilton," as used in these Official Rules, means Hilton Grand Vacations Company, LLC (“HGVC”), its parent, subsidiaries and affiliates. Hilton (the “Sponsor”), its officers, directors, partners, agents and employees and each of their immediate families (spouse, children, siblings, parents and their respective spouses) and those living in their households, each of their advertising and promotion agencies, and their affiliates, licensees, subsidiaries, those involved in the development, production, implementation, and distribution of this Sweepstakes, and/or any other persons or entities associated with this Sweepstakes, including, but not limited to, persons affiliated with Hilton, are not eligible to participate in the Sweepstakes. All federal, state and local laws apply.
This Sweepstakes is void where prohibited or restricted by any national, state, local or other political division or subdivision. Sponsor is not responsible for incorrect or inaccurate transcription of entry information, for problems related to or associated with or utilized in the Sweepstakes, or for any technical or human error which may occur in the processing of the entries in this Sweepstakes, for any human error related to or associated or utilized in the Sweepstakes or entries not received by the deadline for whatever reason. By entering and participating, you accept and agree to be bound by these Official Rules and the decisions of Sponsor which are final and binding on all matters pertaining to this Sweepstakes, and you agree to waive any right to claim ambiguity or error in these Official Rules or in the Sweepstakes. Any person attempting to defraud or in any way tamper with this Sweepstakes will be ineligible for prizes.
SWEEPSTAKES PERIOD: The Sweepstakes begins on December 1, 2007, at 12:01 am Eastern Standard Time (“EST”) and ends on May 31, 2008, at 11:59 pm EST (the “Sweepstakes Period”). During the Sweepstakes Period there will be a total of 6 Monthly Entry Periods whereby one potential winner will be selected for each Monthly Entry Period. All selected potential winners and qualified winners will be ineligible for successive monthly drawings.
MONTHLY ENTRY PERIOD: Each Monthly Entry Period will begin on the first day of each calendar month of the Sweepstakes Period (12/1/2007; 1/1/2008; 2/1/2008; 3/1/2008; 4/1/2008; and 5/1/2008) at 12:01 am EST. For an entry to be considered eligible for that Month’s Entry Period, the entry must be received during the Monthly Entry Period by 11:59 pm EST, on the last day of each calendar month of the Sweepstakes Period (12/31/2007; 1/31/2008; 2/29/2008; 3/31/2008; 4/30/2008 and 5/31/2008) to be considered eligible for that month’s drawing. Entries received after the aforementioned date and time will be submitted for the following month’s drawing, unless no drawings remain. Entries do not roll over from month-to-month. To be considered for each successive month’s drawing you must re-enter within the appropriate Monthly Entry Period.
HOW TO ENTER: There are two ways to enter:
1. Enter via the Internet: Visit http://www.hiltongrandvacations.com/dreamvacations/. to complete and submit the Sweepstakes entry form, including required contact information, pursuant to the on-screen instructions, and you are automatically entered. Entries using macro, script or other forms of automatic entry will be disqualified. If there is a dispute as to the identity of an online entrant, the prize will be awarded to the authorized account holder of the email address. The “authorized account holder” is defined as the natural person to whom the email address is assigned by an internet service provider, online service provider, or other organization (e.g., business, educational institution, etc.).
2. Enter by Mail: You may also enter by mailing a 3” x 5” card, with your name, address, telephone number, age and e-mail address (if applicable) printed legibly. Mail completed entry card to HILTON GRAND VACATIONS “Build and Win Sweepstakes,” 5323 Millenia Lakes Blvd., Suite 400, Orlando, FL 32839 (“Mail-in Entry”). To be eligible for a particular month’s drawing, Mail-in Entries must be postmarked no later than the last day of that Monthly Entry Period. One entry per outer envelope.
Multiple Sweepstakes entries per household during each Monthly Entry Period are permitted, but only one prize awarded per household. Illegible or incomplete entries will be disqualified. Entries become the property of Sponsor and will not be returned.
Released Parties (as defined below) are not responsible for lost, late, stolen, illegible, incomplete, undelivered, misdirected, delayed, mutilated or postage due mail or entries, or lost or stolen entries; or for any technical, mechanical, printing, typographical, human or other errors relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in administration of the Sweepstakes, the processing of entries, the announcement of the prize or in any Sweepstakes-related materials.
WINNERS SELECTION: One potential winner will be selected for each Monthly Entry Period by random drawing on or about the 15th (fifteenth) day of the successive calendar month for each Monthly Entry Period during the Sweepstakes Period by Sponsor (whose decisions are final and binding in all respects relative to this Sweepstakes) from among all eligible entries received. If the 15th falls on a Saturday, Sunday or US holiday, the Drawing will be held on the following business day.
The potential winner will be notified by registered mail. Odds of winning depend on number of eligible entries received for each drawing. The potential winner will be required to sign an affidavit of eligibility and a liability release and, where lawful, a publicity release, all of which must be signed, notarized (the Prize Documents”) and returned within ten business (10) days of date of issuance of the prize notification and all Official Rules must be complied with or prize may be forfeited and an alternate winner may be randomly selected. A prize notification which is returned as undeliverable or unclaimed will result in the prize being forfeited and awarded to an alternate winner. A pre-paid overnight return envelope will be provided. Selected winners will be ineligible for future monthly drawings in this Sweepstakes.
PRIZE(S): A total of Six (6) prizes will be awarded. Each prize consists of 10,000 ClubPoints to be redeemed within the Hilton Grand Vacations Club exchange program (the “Club”) operated by Hilton Grand Vacations Club, LLC, to reserve resort accommodations and ClubPartner Perk travel services available through the Club by calling 1-800-521-3110 ext 3104. Prize will be awarded within thirty (30) days of Sponsor’s receipt and acceptance of complete Prize Documents. Prize may be redeemed beginning on the date of award and all travel must be complete on or before December 31, 2009 (“Travel Period”). Winner must give a minimum of forty-five (45) days advance notice of desired departure date. Final departure date may be selected by Sponsor in its sole discretion. Once booked and a confirmation is issued, the transaction is final; no cancellations or changes permitted. Any changes or cancellations will result in forfeiture of the ClubPoints applied to that transaction. In the event a selected winner fails to use any or all of their assigned ClubPoints within the Travel Period, the ClubPoints shall expire. ClubPoints and reserved travel arrangements may not be assigned or transferred.
ClubPoint usage is subject to the terms and conditions of the Hilton Grand Vacations Club which rules shall be provided to the selected winners with the winner notification documents. Additional terms and conditions may apply from travel service providers and such services are subject to change and availability. Any depiction or display of prizes, dates, calendars, point values or floorplans is for illustration purposes only and do not reflect actual prizes that may be awarded.
Approximate retail value of each prize will be less than or equal to $5000. Total value of all prizes awarded will be less than or equal to $30,000. No cash redemption for awarded ClubPoints or reserved travel.
PRIZE CONDITIONS AND RESTRICTIONS: All transportation, meals, excursions, spending money, gratuities, incidental charges, phone calls, faxes, taxes, fees and any other expenses incurred by the winner are the sole responsibility of the winner and his/her travel companion(s). The use of 10,000 ClubPoints is subject to availability of the options selected and restrictions apply.
Any state and local government surcharges, taxes, fees (sales, income (federal, state and local), airport, value-added and other), gratuities, licenses, incidental expenses, registrations, port charges, telephone calls, travel insurance premiums, and other costs and expenses relating to Sweepstakes and use or acceptance of the prize is the sole responsibility of the winner. Trip and travel insurance is not included. Blackout dates and any other applicable travel restrictions may apply. Travel will not be eligible for frequent flyer points or miles. Winner and his or her travel companion(s) are solely responsible for determining and obtaining all necessary travel documents and other travel requirements including but not limited to passports, visas, etc. No changes will be made to travel details once any portion of travel arrangements have been made, except at Sponsor's sole discretion.
If selected winner elects to use the awarded ClubPoints for RV or Cruise excursions, additional restrictions, include but are not limited to the following: RV Excursions: Renter must be a minimum of 21 years of age (25 years at some locations) and must have a major credit card, valid driver’s license and automobile insurance as required by the RV provider. Prize award covers one driver only. Any fees incurred, including storage, security deposit, upgrades, fuel, additional mileage, late fees service, damage, cleaning or other fees imposed by the RV excursion provided not included. Cruises: Transportation to and from cruise embarkation/disembarkation locations are not included. Some specialized restaurants and beverages may incur additional fees and reference the member guide for more details.
Winner and his or her travel companion(s) will be required to provide appropriate Federal, national or state government issued photo identification at time of travel prior to departure. Travel companion(s) are required to travel on identical itineraries.
Released Parties (as defined below) are not responsible for changes in schedule of any element of a travel prize. Released Parties are not liable for any expenses incurred as a consequence of cancellations/delays. Released Parties will not replace any lost or stolen tickets, travel vouchers or certificates. Travel companion(s) will be required to sign a release of liability prior to reservations of travel arrangements. If travel companion(s) is a/are minor(s), s/he must be accompanied by his/her parent/legal guardian on trip.
CONDUCT: If for any reason the Sweepstakes is not capable of running as planned, including tampering, unauthorized intervention, fraud, technical corruptions or failures, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion, to disqualify any individual (and his or her Sweepstakes entry) who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes and void such entries. Should the Sweepstakes or any portion thereof be suspended or terminated prior to the stated termination date, notice will be posted on Sponsor’s home page (www.hiltongrandvacations.com). In the case of Sweepstakes termination, the prize(s) will be awarded, at Sponsor’s sole discretion, in a random drawing from among all eligible, non-suspect entries received by the termination date.
If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor’s sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof. In the event this Sweepstakes is cancelled, the Sponsor will conduct a random drawing to award the prize from among all eligible, non-suspect entries received prior to the time of the action or event warranting such early termination. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
RELEASE: By participating in this Sweepstakes, all entrants acknowledge and agree to release, discharge and hold harmless Sponsor, and each of their parent, subsidiaries affiliates, franchisees, advertising and promotion agencies, and those involved in the development, production, implementation, and distribution of this Sweepstakes, and/or any other persons or entities associated with this Sweepstakes, including, but not limited to, persons affiliated with Sponsor, and all of the respective officers, directors, employees, shareholders and agents of the foregoing (collectively, the “Released Parties”) from and is not responsible or liable for any liability with respect to all aspects of this Sweepstakes (including without limitation, any illness, losses, litigation, personal injury, death, property damage, and claims based on publicity rights, defamation, or invasion of privacy, reasonable attorney’s fees and court costs) that may occur from participation in this Sweepstakes or the acceptance, possession, use or misuse of the prize (including any travel or activity related thereto.
LIMITATIONS OF LIABILITY: Released Parties shall not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’s sole control. Released Parties shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carrier(s), hotel(s), cruise line(s) or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Released Parties shall not be liable for any loss or damage to baggage. By participating, the entrants grant Sponsor and its advertising and promotion agencies the right to use and publish their names, voices, statements, cities and states of residence, photographs and/or other likenesses, on-line and in print, or in any other media now or hereafter known, worldwide and in perpetuity, without additional compensation, notification or permission, unless prohibited by law.
GOVERNING LAW: Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the state of California, without regard to conflicts of law. All suits or claims brought in connection with this Sweepstakes must be brought in a state or federal court in Los Angeles, California.
